New Workers’ Rights and Rules in India

Introduction

  • Major Reform: India has now started all four Labour Codes—Wages, Industrial Relations, Social Security, and Safety—from 21 November 2025. These four codes have replaced 29 old labour laws.
  • Simple System: Earlier, factories and companies had to follow many different rules. Now everything is brought together in four codes so that rules are easier to understand and follow.

  • Equal Pay Rule: This code makes sure that men and women doing the same work must get the same pay.

Industrial Relations Code

  • Layoff Limit: Companies now have a clear rule on when they need government permission for layoffs or closing units. This helps medium and big companies plan work better.
  • Appointment Letter: Every worker must receive a proper job letter, so that their job terms are written clearly.
  • Dispute Handling: This code sets a better process for solving fights between workers and management, so problems do not drag on for months.
  • Better Flexibility: Companies get some freedom to hire or change staff according to work needs, but workers’ rights are also protected.

Code on Social Security

  • More People Covered: Benefits like PF, pension, insurance and maternity help will now also cover gig workers, delivery workers, app-based workers and unorganised workers.
  • Portable Benefits: Workers can carry their PF and other benefits even if they change states or jobs.
  • Contribution Rules: This code explains how much workers and employers will contribute to social security funds, including special systems for gig workers.
  • Support for Women: Women workers get stronger maternity leave rules and better protection under this code.

Occupational Safety, Health and Working Conditions Code (OSHWC)

  • Safety Rules: All workplaces must follow updated safety rules so that workers remain safe while working.
  • Free Health Checkups: Workers must get a free medical check-up every year to catch any work-related health problem early.
  • Work Hours: Total weekly hours remain fixed, but daily hours can be adjusted with limits so work is not too tiring.
  • Women’s Safety: Women can work in any shift, including night shift, but companies must provide safe conditions and facilities.
  • Basic Facilities: Workplaces must have clean toilets, drinking water, rest areas, and other basic needs.

  • Workers’ Benefits: Workers will get better wages, safety, medical checkups, written job letters, and social security—even gig and unorganised workers get protection now.
  • Company Benefits: With fewer laws and clearer rules, companies can follow regulations more easily and save time.
  • Government Benefits: The rules become easier for governments to check through online systems and common registers.

Implementation Challenges and Next Steps

  • State Preparation: States must finish making their rules; otherwise, the codes cannot work smoothly everywhere.
  • Department Upgrade: Labour offices need better staff training and digital systems to handle new responsibilities.
