New Data law and Journalism

• The process of formulation rules and regulations to operationalise India’s first comprehensive data protection law, the Digital Personal Data Protection Act (DPDP) 2023 is expected to be started after the successful completion of the General election.
• The main point in this Data Protection Act is to obtain consent from people for the publication of their personal Data.
• Under the Act, the basic right to protect the personal Data is provided and it also ensures some obligations on companies for using someone’s personal Data.
• Journalistic activities are generally exempted from the data privacy acts as the three previous drafts of DPDP had exempted journalistic activities from privacy Regulations but in the final draft,the story has been changed as the final law withdrew such an exemption.
• This law creates some risk to the journalistic activities because they would need consents for publishing anyone’s personal Data and it also empowers the government to call for information from any Data processing institutions in India.
• This law endangers the power of Journalism to discharge their role and may impact the confidentiality of journalistic activities.
• The reasons to exempt journalistic activities from the Data Protection Act are still not clear.
• One of the best options to get feedback from people in any law is to conduct a transparent and open public consultation model and the government has conducted some of these arrangements but there was no clarification to exempt journalistic activities from the Data Protection Act.
• The government must rethink and provide exemption to journalistic activities from the Data Protection Act and make sure the credibility of journalistic free speech in India.
