• The arguments between the Punjab government and the central government over the issue of expanding the area limit for the border security force (BSF) to operate under jurisdiction are the result of lack of communication and consultation between central and state governments.
• Recently, the Punjab government has filed a case under the article 131 of the constitution against the central government challenging the decision to expand the area of operational jurisdiction of BSF from 15 km from border to 50 km from the border.
• Punjab government finds the decision as the encroachment into the law and order of Punjab police and also it is a breach of Federal principles.
• Along with Punjab, West Bengal has a similar point of view regarding the expansion of the operational jurisdiction of the BSF.
• In October 2021, the center had passed the resolution to expand the operational jurisdiction area of BSF in Punjab, Assam and West Bengal from 15 km to 50 km, in Gujarat it was reduced from 80 km to 50 km and for Rajasthan it remained the same as 50 km.
• As the explanation, the Central government replied that the decision was taken to help the BSF to discharge its border patrol duty more effectively.
• The motive behind the decision was valid and it shouldn’t be treated as the encroachment of law and order of state police.
• The main aim of BSF is to prevent trans border crime, especially unauthorized entry and exit from the border. Moreover it doesn’t have the power to prosecute offenders but it has to hand over those offenders to the local police.
• Practically, BSF always works in coordination with the local police.
• The decision gives the right to BSF to conduct more search operations especially in cases where acquit manages to enter deeper from the border.
