Indian Parliament had passed four codes on four broad codes on wages, industrial relations, social security and occupational safety health & working conditions (OSH) which would ultimately replaces 44 central labour laws.

The Code on Wages had passed by Parliament in 2019 while the three other codes cleared from both the Houses in 2020.

The government has released four Labour Codes to modify the rules governing employer-employee relations and modify labour laws. A series of reforms relating to pay, social security (pension, gratuity), labour welfare, health, safety, and working conditions are defined in the recently approved labour codes (including women).

Working Hours:

The daily and weekly working hours have been limited to 12 hours and 48 hours, respectively, under the new labour codes. This has cleared the possibility toward the introduction of a 4-day work week (assuming 12 working hours every working day in the week).

Definition of ‘Worker’:

The new labour codes’ definitions of “workers” are same as prescribed in the Factories Act, but this does not mean that only workers in blue collar jobs, such as those employed in factories, are also entitled for the benefits. Since the law no longer fixes the definition of workers to those employed in factories, a software development company would also be thought to fall under its purview.

Working Hours:

The maximum amount of overtime hours for employees has been increased from 50 hours to 125 hours, under the new labour laws. This would give opportunity to businesses the flexibility to switch to a 4-day work week and hire people on the weekends.

Leave rules:

In addition to working hours, the government has also tried to modification in leave rules as below:

  • The leave that employees may have while employed
  • The carry forward of unused leave to the following year
  • The ability to apply unused leave while still employed
