The investigation into the murder of the doctor has been taken over by the CBI

The Calcutta High Court has ordered a transfer of the investigation, noting that the police have made little significant progress. The court acknowledged the petitioners’ concerns about delays in the probe and determined that immediate action was necessary given the facts and circumstances of the case. Additionally, the court has urged the striking doctors to end their protest, emphasizing their moral duty to care for patients.

  • On Tuesday, the Calcutta High Court moved the investigation into the rape and murder of a doctor at R.G. Kar Medical College and Hospital to the Central Bureau of Investigation (CBI).
  • A Division Bench, with Chief Justice T.S. Sivagnanam and Justice Hiranmay Bhattacharyya at the helm, noted that initially, the investigation seemed to show little progress. Following the High Court’s direction, control of the case has been taken over by the CBI. On Wednesday, forensic and medical experts, along with a team of officers, are set to arrive in Kolkata to inspect the crime scene.
  • “The State police have not detained anyone else who might be implicated in the crime. The location where the crime occurred is of significant importance, as it took place in a government hospital,” the Division Bench remarked in its order.
  • The court remarked that it would be appropriate to point out that the administration had not supported the victim or the victim’s family. It observed that the facts and circumstances of the case required timely action, as there had been no significant progress in the investigation even after five days.
  • “Considering the significant chance that evidence could be tampered with and witnesses swayed, we find solid grounds to agree with the request made by the writ petitioners, specifically the victim’s parents.”
  • The Court instructed the police to deliver the case diary and all related records, including CCTV footage, statements, and other materials, to the CBI officer present in court by 10:00 a.m. the next day.
  • The Bench requested that doctors end their strike, emphasizing their duty to treat patients, especially those from less privileged backgrounds at government hospitals.
  • The Court highlighted the moral responsibility of doctors to continue treating patients, particularly those who rely on public healthcare services.
  • Despite welcoming the High Court order, the doctors maintained their strike and set a Wednesday deadline for the investigation’s completion.
  • Previously, Chief Minister Mamata Banerjee had set an August 18 deadline for the Kolkata Police to resolve the case, cautioning that if they did not succeed, she would hand it over to the CBI.
  • The Chief Justice questioned why the principal of the medical college did not initially register a murder case, opting instead for an unnatural death case at Tala police station, which was deemed a serious lapse and raised suspicion.
  • The court highlighted that, typically, an unnatural death case is registered only when there is no formal complaint. In this case, it was especially surprising that no formal complaint was lodged by either the hospital or the principal, given that the deceased was a doctor at the hospital.
  • The principal of R.G. Kar Medical College and Hospital, Sandip Kumar Ghosh, was criticized by the Division Bench for failing to file a police complaint concerning a death that occurred within the hospital premises.
  • The Bench noted that Ghosh had the opportunity to report the incident to the police due to its occurrence on the hospital grounds.
  • The court criticized the principal and his officers for neglecting their duties and questioned the urgency of Mr. Ghosh’s appointment to another government medical college, directing that he be placed on leave until further notice.
  • Suvendu Adhikari, the Leader of the Opposition in the State Assembly, endorsed the High Court’s decision and called for Chief Minister Mamata Banerjee’s resignation, citing her failure to protect women doctors in state-run hospitals.
  • The court’s decision reflects serious concerns about administrative lapses and inadequate safety measures for medical staff.

  • In a separate incident, a mine blast along the Line of Control in the Mandi area of Poonch resulted in injuries to a soldier and two porters. Official sources reported that the explosion occurred near the Tekri Post in Mandi at around 2:30 p.m., injuring Havildar Inderjeet Singh and porters Shakeel Hussain and Neeraj Choudhary.
  • Former Chief Ministers of Jammu and Kashmir, Omar Abdullah and Mehbooba Mufti, each voiced their concerns separately about the increasing casualties among security forces.
