Ending discrimination

  • The Supreme Court of India has come out strongly against the rule of terminating employment of a woman on the grounds of marriage is unconstitutional and a course of gender discrimination.
  • This statement through the Supreme Court has come out on the Union of India and Others vs Ex. Lt. Selina John case.
  • Selina John, a former lieutenant and Permanent Commissioner Officer in the Military Nursing Service, was terminated from the service for getting married.
  • According to the Supreme Court this type of patriarchal rule diminishes human dignity and fair treatment. This also undermines the right of non discrimination.
  • The Supreme Court bench led by Justice Sanjiv Khanna ordered the union government to pay ₹60 lakh to Selina John as the compensation.
  • The Lucknow Bench of the Armed Forces Tribunal which had ruled in Selina John favor in 2016 and an appeal was held against the decision by the Union government in the Supreme Court.
  • The Court noted that the decision was wrong and illegal and only applicable to women nursing officers.
  • Women are also questioned at job interviews about their future plans on marriage and motherhood and these questions are really uncomfortable.
  • In accordance with the increase in the number of women in the workforce, barriers in the education system, discrimination in employment and opportunities have to be broken down.
  • Many girls in India especially who come from poor backgrounds have to drop out from schools and colleges due to various reasons from economic reasons to lack of proper toilets and hygiene.
  • According to the UN gender snapshot 2023 report, if strict measures are not taken to eradicate the discrimination against gender, the next generation of women will still face difficulties and have a disproportionate amount of time in duties compared to men.
