CBI Requests Death Penalty for Convict in R.G. Kar Murder Case

• The Central Bureau of Investigation (CBI) filed an appeal before the Calcutta High Court on Wednesday, requesting that the life imprisonment of a convict in the rape-murder of a doctor be upgraded to the death penalty.
• Earlier, the CBI opposed the West Bengal government’s petition seeking a harsher sentence for Sanjay Roy, the convict and former civic police volunteer.
• On Tuesday, the State’s Advocate-General, Kishore Dutta, had approached the Division Bench, urging for capital punishment instead of the life sentence.
• The Deputy Solicitor-General, Rajdeep Majumdar, countered the West Bengal government’s appeal, arguing that the state did not have the right to appeal the trial court’s decision on grounds of inadequacy.
• Majumdar also emphasized that the CBI had previously sought the death penalty for Roy in the trial court.
• The Division Bench indicated it would hear the CBI, the victim’s family, and the convict’s lawyers before deciding whether to admit the appeal filed by the West Bengal government.
• The matter is set to be heard on January 27.
• Judge Anirban Das of the Sealdah Additional District and Sessions Court had previously spared Roy from the death penalty, stating that justice should not mirror brutality but should rise above it with wisdom and compassion.
