Women’s right to choose her own identity

  • If society wants equal rights for women in every field, every act that confirms patriarchal mindset must be stopped and vanished.
  • The case of Ms. Divya Modi Tonga who wanted to revert her maiden name after the divorce comes through has been appealed in the Delhi high court.
  • Divya Tonga arrived at Court after facing problems to revert her maiden name as per the government notification that stated if a married woman wants to use her maiden name after divorce must need a no objection certificate from her husband.
  • According to the Ms Tonga this government notification is gender biased and creates unnecessary barriers in front of the women who want to change her surname or maiden name after divorce that should be her constitutional right and it also violates the article 14, 19 and 21.
  • The statement to bring NOC from husband in the case of changing maiden name is objectionable and also justifies misogyny that wants to control an individual’s identity.
  • Women have faced challenges and harassment whenever they chose a path which is different and free.
  • Those women who have decided to not choose her husband’s surname face many problems when it comes to open joint accounts , during child admission in school and also while applying for passports. They need to do so much unnecessary paperwork.
  • A society that is already fighting with caste based discrimination, these gender biased norms make it more difficult to deal with differences and humiliation.
  • India , which is the most populous country in the world, still has gender biased norms both politically and socially.
  • According to the United Nations, the greatest human rights challenge around the world is gender disparity.
