  • The Lok Sabha passed the Banking Laws (Amendment) Bill, 2024, marking the first Bill of the Winter Session after resolving a week-long logjam.
  • The Bill, introduced by Finance Minister Nirmala Sitharaman, was approved through a voice vote.
  • It allows bank account holders to have up to four nominees and redefines “substantial interest” for directorships, increasing the financial threshold to ₹2 crore from ₹5 lakh.
  • The tenure of directors, excluding the chairman and whole-time directors, in cooperative banks will increase from eight to ten years, aligning with the Constitution (Ninety-Seventh Amendment) Act, 2011.
  • The Bill allows a director of a Central Cooperative Bank to be a member of the Board of a State Cooperative Bank.
  • Banks will gain greater autonomy in determining the remuneration for statutory auditors.
  • The reporting dates for regulatory compliance by banks will shift to the 15th and last day of each month instead of the second and fourth Fridays.
  • Sitharaman stated the amendments aim to strengthen banking governance and enhance customer convenience in nominations and investor protection.
  • Depositors can choose successive or simultaneous nomination, while locker holders will have only successive nomination options.
  • Opposition members criticized the Bill, raising unrelated issues like increased imports from China, demonetization, and electoral bonds.
  • Concerns about rising fees for basic banking services and cyberfraud risks for senior citizens were highlighted during the debate.
  • Suggestions were made for stricter measures against financial fraud, including compensation for victims before sentencing perpetrators.
  • Critics pointed out economic challenges like inflation at 6.21%, slow GDP growth at 5.4% in Q2 FY25, and the rupee’s depreciation to ₹84.73 against the dollar, raising concerns about potential stagflation.
